OSHA does not believe that this is a provision that would add to the protections of the rule. The HCS is intended to train all workers about the hazards of chemicals and appropriate protective measures. It is not clear what additional training a worker would have to have to be designated a “competent person.” The intent of the rule is to ensure that all workers are trained to be “competent.” In addition, it was suggested that the “competent person” would have the authority to stop the job or correct the hazards. This type of action is beyond the information transmittal requirements of the HCS.
